2、规定送交学位论文。 关于学位论文使用授权说明 摘要 近期, 双汇瘦肉精 事件、 沈阳毒豆芽 事件等重大食品安全亊故接连发 生,牵动着普通民众的神经,也折射出当前我国食品安全监管领域中的监管不作 为乱象。在严峻而又复杂的食品安全形势下,有效整治食品监管领域行政部门的 不作为,已经成为了当前的热点话题。上述两个案例反映了我国食品安全监管行 政不作为的主要表现形式,包括:监管不及时、监管不到位、拒绝监管 .三个方面。 这种监管不作为的违法行为,不仅严重危及人民群众的生命财产安全及国家安 全,而且造成政府职能的缺位,不利于依法行政,损害政府形象及公信力。究其 原因,主要有以下几点:第一,食品安全分段监
3、管模式导致主体缺乏明确性,监 管主体之间协调机制不够畅通;第二,监管部门能力有限,而监管任务繁重;第 三,各监管部门职责权限划分不清,食品安全监管执法领域范 _界定不清;第四, 立法 上行政监符不作为法律责任的规定存在缺陷,司法上主动介入行政监管不作 为而临 W难。 为有效规范食品安全行政监管不作为,保障民众生命健康安全,我 W 应 3枳 极采取以下措施:明确各监赀主体的权力界限、加强监管屯体协调;完轉行政诉 讼制度,发挥司法解决行政权限争议的功能;进一步明确监管部门的作为义务范 以及不作为的法律责任;健全食品安全法律责任追究机制,扩大行政监管不作 为 W 任追究 :K 体的范,在行政贪任追究
4、机制屮引入 W 家公诉人制度,将知怙第 i 人纳入行政 w 仟迫究体制中来,将行政赔偿作为食品安企法律责任的承担形式 之一;加强食品监管队伍迚设、提 A 监符执法能力。 关键词讧品安全,彳 1政监管, +作为,法律对策 I ABSTRACT Recently, there have happened significant food safety incidents one after another, like the incident of Shuanghui clenbuterol-tainted products and poisonous bean sprouts incident
5、in Shenyang, which make the ordinary people nervous and also reflect the administrative nonfeasance of food supervision in our country. It has been a hot topic about how to remedy the administrative departments nonfeasance in the field of food safety supervision in such serious and complex food secu
6、rity situation. The main exhibition forms reflected in the two administrative nonfeasance cases, are listed as the following three aspects: untimely supervision, incomplete supervision and refusing to supervise. These illegal behaviors not only seriously endanger peoples life and property safety and
7、 national security, but also cause the absence of the government function and are harmful to the goverment to carry out its official duties in accordance with the law, thus damaging peoples trust and the image of the government. According to the analysis above. I think there exist the following seve
8、ral reasons: firstly, the model of food safety regulation in subsection leads the principal duties and obligations of administrators unclear and indefinite, which blocks coordination mechanism between the supervision departments; secondly, the regulatory department lacks funds with too many regulato
9、ry objects; thirdly, the responsibility purview division of every regulatory department is not clear, causing the enforcement range of food safety regulatory field equivocal; fourthly, a defect is that administrative nonfeasance is not as the provisions of bearing the legal responsibility, making ju
10、dicial departments proactive intervene in administrative nonfeasance very difficult. In order to remedy administrative nonfeasance of food safety supervision and ensure the safety of peoples life and health, countermeasures are put forward as the followings: 1) to definite the regulatory departments
11、 power range and strengthen coordination between various main departments of supervision: 2) to perfect the administrative litigation system and bring the function into play that the judicial administrative sII nonfeasance; 4) to perfect responsibility system against food safety laws, enlarge the re
12、sponsibility range of main duty officers for the charge of nonfeasance and introduce state prosecutor system in the administrative responsibility mechanism, whoever in the know as the third person to be included in the administrative responsibility system and administrative compensation as one form
