1、香港新世界大厦物业管理合同二零零二年七月香港新世界大厦物业管理合同本物业管理合同于二零零二年月日订立。甲方:上海新世界淮海物业发展有限公司注册地址:上海市卢湾区淮海中路300号乙方:上海新创物业管理有限公司注册地址:上海市卢湾区淮海中路300号 地库一层兹证如下:1.定义於本文件中1.1 物业 指香港新世界大厦,位於上海市卢湾区淮海中路300号的建筑物;1.2 物业管理 指对物业整体、物业内外公共地方/公共设备设施的管理与控制,以及对物业所有业户提供的管理服务;1.3 业户 指物业的所有业主或租户;1.4 管理合同 指香港新世界大厦物业管理合同,即本合同。1.5 管理帐户 指由甲方为本物业开立

9、理队伍物业接管验收服务安排业户收楼/入伙业户装修期间的管理服务提交公共区域的绿化、设备设施运行/维修/管理、保洁等的管理方案制作物业管理方面各项规章制度与及有关文件和表格制定计划并开展员工培训为物业重要设备的保养外判事项提供意见和建议,及提供最新资讯4.实务管理4.1乙方负责执行对整个物业所属的设备设施的运行/维修/管理、保安、保洁、绿化、业户服务等物业管理方面的实务运作。4.2实务管理包括但不限于:4.2.1为物业重要设备或清洁事项选择并委托有相应资质的承办商,并负责对其行政管理及监督,惟须在委托/签署委托合同前先与甲方商洽;4.2.2对乙方代表甲方聘用的所有物业管理方面员工的行政管理及监督

17、.2.7执行本管理合同内所订定的管理条款及责任;4.2.8乙方应经常检讨工作情况并按情况需要与甲方举行会议以作跟进,乙方主持该例会,并向甲方提交有关会议记录。4.2.9当大楼发生突发事件或严重事故,乙方应于一个工作日内向甲方提供情况报告,七个工作日内提供专题报告。5.财务管理5.1香港新世界大厦物业管理处的启动费用(如:购置管理处家具、电脑、工程工具、制作员工制服等),先由甲方垫付,乙方按照下列第条的规定执行。5.2由甲方为本物业开立独立的管理帐户(作为本物业收取物业管理费等物业管理方面的收入并支付各项管理开支款项之用),此帐户应与甲方的其他帐户分开处理。5.3在本合同管理期内,甲方所有租户或
18、小业主(如售卖)自收楼之日起均按照办公楼单元美元每平方米建筑面积每月、商场单元 9 美元每平方米建筑面积每月、停车场 200元人民币每个车位每月的管理费标准缴交物业管理费于该帐户。5.4如按照实际开支情况并针对市场整体物业管理费水平的变化,需调整本物业的物业管理费标准,则须由甲方与乙方共同商议确定新的物业管理费标准并签署补充协议后执行。本合同其他条款仍为有效。5.5对于甲方暂未租出或售出(如售卖)的单元,甲方不需缴交空置管理费,唯甲方承诺每月检讨管理帐户的收支情况,当管理帐户的收入不能应付物业各项管理开支时,甲方必须当即足额补贴,确保物业的管理运作正常。该等甲方贴补的款项逐项记录,并经由乙方确
19、认。随物业出租率的提高,如管理帐户中管理方面的收入减去支出后仍有盈余,则经乙方书面确认,该盈余优先用于偿还甲方垫付的启动费用,而后偿还甲方前述每月贴补的各项费用。如偿还甲方贴补费用后仍有节余,经甲乙双方书面确认,可用于本物业的设施设备大修、翻新或其他有关本物业的重要事项。5.6乙方向甲方提供专业财务管理知识及援助。5.6.1 乙方负责协同甲方管理该管理帐户,督导整个物业管理方面的诸如物业管理收取、开销、预算等会计工作;文档编码:CH2O2H5W1H4 HM8H5D8U1V4 ZA9X5A7M1U4文档编码:CH2O2H5W1H4 HM8H5D8U1V4 ZA9X5A7M1U4文档编码:CH2O
