2、d Number:地址Address:合約之第三方(以下簡稱經紀人):Party C(hereinafter referred to as the Agent):姓名Name:身份證號碼Identity Card Number:註冊地址:Registered Address:合約三方茲同意買賣條款如下:All three partes agre e on the terms and conditions as follow:1、買賣雙方經協商須以下列條款通過經紀出售及購入位於(以下簡稱該物業)之物業。Both The Vendor and The Purchaser shall sell or
3、 buy the house located at(hereinafter refers to as the property)through The Agent according to the following terms and conditions The gross floor area of the property is square meter.2 AC1 and The Purchaser shall pay in the following manner(choose one from A to C).ACASH PAYMENT a shall be paid as in
4、itial deposit upon signing this agreement b RMB which shall be signed on or before c RMB shall be paid as remaining balance of the purchase price when closing the transaction which shall be singed on or before B MORTGAGE PAYMENT a RMB shall be paid as initial deposit upon signing this agreement b RM
5、B shall be signed on or before c RMB shall be paid as remaining balance of the purchase price by the mortgage bank when the transaction is completed and all other formalities of mortgage loan registration settledThe differences between the actual and the original mortgage loanif anyshall be paid in
6、cash by The Purchaser C Submortgage a shall be paid as initial deposit upon signing of this agreement within Days after accepting the said deposit The Vendor shall apply for submortgage to the mortgage bankand shall assist The Purchaser to apply for the mortgage loan b RMB shall be paid as partial d
7、eposit upon signing formal sale&purchase agreementwhich shall be signed on or before c RMB shall be paid as remaining balance of the purchase price by the mortgage bank when the transaction is complete and house encumbrance,deducting vendors arrearage.The differences between the actual and the origi
8、nal mortgage loanif anyshall be paid in cash by The Purchaser DRevocation of mortgage RMB shall be paid as partial deposit within days after signing this agreement and The Vendor shall immediately apply for Revocation of mortgage of the Propertys title from the mortgage bank on the same day of accep
9、ting the said deposit.The Vendor shall signing formal sale&purchase agreement with the Purchaser assist The Purchaser to apply for the mortgage loan within Days after finishing all formalities of redeeming titledischarging mortgage registration and filingwhereas these formalities shall be finished n
10、ot later than 3Tax paynet method 4/When the transaction is completedThe Vendor shall deliver the possession right of the property to The Purchaser/The Purchaser agree on purchasing the property with the existed tenancy agreement.5 The property is sold to The Purchaser in status quoand The Purchaser
11、has already inspected the property and deemed acceptableThe Purchaser shall not refuse to complete the transaction on this excuxe.6 The Vendor shall settle all outgoing utility charges in respect of waterelectricitygas management and telephone fee related to the property before the transaction of th
12、e property is completed.7 The Vendor shall ensure that he enjoys the full title right of the property with absolute control and is lawful to dispose of the property.And The Vendor shall settle any encumbrances related to the possession rightsdebtstaxation and tenancymortgage and so forth before the
13、transaction is completed otherwise any loss hereafter caused shall be borne by The Vendor.8 The initial deposit paid by the Purchaser shall be confirmed after The Vendor accepting the said deposit and sign this agreement.If The Vendor refuse to accept the sail deposit and sign the agreementthe said
14、deposit will be refunded to The Purchaser without any compensation and The Purchaser shall not claim for any compensation.9 Provided that The Purchaser fails to perform any terms of this agreement and therefore this agreement cannot be executed properlythe paid deposit by The Purchaser can be forfei
15、ted by The Vendor and The Vendor shall have the right to resell the property to other parties.But The Vendor shall not run further obligation or claim fo compensan on to The Purchaser.10 If The Vendor fails to sell the property to The Pruchaser after accepting the deposit according to the terms of t
16、his agreement shall refund all paid deposit to The Pruchaser and pay the same amount of money to The Purchaser to compensate his losses.But The Purchaser shall not ask for further compensation or force The Vendor to further execute this agreement.11 .The Agent is entitled to collect a sum of RMB/HKD
17、 from The Vendor and a sum of RMB/HKD from The Purchaser as the commission after signing this agreement owing to his services provided related to this transaction for two parties.And this commission shall be paid not later than the date of.12 Either The Vendor or The Purchaser who fails to sell or b
18、uy the property according to the terms of this agreement shall immediately pay a sum of RMB/HKD as the compensation to The Agent.13 If The Venlor and The Purchaser rescind this agreement without the endorsement of The Agent after signing this agreementboth parties will be regarded as breaching of re
19、pudiation of agreement and each shall pay the above-stated commission to The Agent.14 Both The Vendor and The Purchaser shall provide all necessary documents of this transaction.15 This agreement replaces any previous statementunderstandingpromises and agreements during the negotiation among three parties.16 The agreement has three copies with the same legal effects and is held respectively by The Vendor The Purchaser and The Agent.17Remarks The signatures of three parties on the above mentioned date.Acknowledged the receipt of above deposit of RMB/HKD.The Purchaser The Vendor The Agent
